1. What South Florida Backyard Nectar is
South Florida Backyard Nectar ("the Site," "we," "us") is a listing platform that connects independent fruit growers ("Growers") with buyers ("Buyers"). We provide a place for Growers to list fruit they have available and for Buyers to find and contact Growers directly.
We are not a party to any transaction between a Grower and a Buyer. We do not sell fruit, do not take title to or possession of any fruit, do not process payments, and do not handle shipping, delivery, or pickup logistics. All sales, pricing, payment, and fulfillment are arranged directly between the Grower and the Buyer, entirely outside of this Site.
2. Grower responsibilities
By creating a Grower account and posting listings, you represent and agree that:
- You are legally permitted to grow, possess, and sell the fruit you list.
- You are solely responsible for complying with all applicable federal, state, and local laws governing the sale of homegrown produce, including any applicable cottage food laws, agricultural regulations, and food safety requirements in your jurisdiction.
- You will accurately describe your listings, including quantity, condition, and how the fruit was grown.
- You are solely responsible for the quality, safety, and condition of any fruit you sell, and for any packaging, handling, or shipping you undertake.
- You will keep your listings reasonably current and understand that listings not updated within 7 days may be automatically hidden from search results.
3. Buyer responsibilities
By submitting an order request or contacting a Grower through the Site, you agree that:
- Any purchase, payment, pickup, or shipping arrangement is a private agreement between you and the Grower, not with the Site.
- You are responsible for asking Growers any questions you have about how fruit was grown, handled, or should be stored before completing a purchase.
- The Site does not inspect, test, or certify any fruit listed by any Grower.
4. No warranty; assumption of risk
THE SITE, AND ALL LISTINGS ON IT, ARE PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. We make no representations or warranties about the quality, safety, legality, or fitness for consumption of any fruit listed by any Grower. Consuming fresh produce, including produce grown or purchased through this Site, carries inherent risk, and you assume that risk when you purchase or consume fruit obtained through a connection made on this Site.
5. Limitation of liability
To the fullest extent permitted by law, South Florida Backyard Nectar and its operators are not liable for any damages, injuries, illness, financial loss, or disputes arising from a transaction, communication, or interaction between a Grower and a Buyer, including but not limited to disputes over price, quality, condition, payment, delivery, or the fruit itself.
6. Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. You must provide accurate information when creating an account and keep it up to date.
7. Content you submit
You retain ownership of the listing descriptions, profile information, and any other content you submit ("Your Content"). By posting Your Content on the Site, you grant us a non-exclusive, royalty-free license to display it on the Site for the purpose of operating the marketplace. You are responsible for ensuring Your Content does not infringe anyone else's rights.
8. Prohibited conduct
You agree not to:
- List anything other than fruit you have grown or are authorized to sell.
- Use the Site for any illegal purpose.
- Attempt to circumvent, disrupt, or interfere with the Site's operation or security.
- Misrepresent your identity or your affiliation with any person or entity.
- Harass, threaten, or abuse other users through the Site's contact or order features.
9. Termination
We may suspend or terminate any account, at any time, for any reason, including violation of these Terms.
10. Changes to these Terms
We may update these Terms from time to time. Continued use of the Site after changes are posted constitutes acceptance of the updated Terms.
11. Governing law
These Terms are governed by the laws of the State of Florida, without regard to conflict of law principles.
